PLEASE READ THIS END-USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE CLICKING THE "I AGREE" BUTTON, DOWNLOADING OR USING THE ONFIDO DEMO APP ("APPLICATION").
By clicking the "I Agree" button, downloading or using the Application, you are agreeing to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not click on the "I Agree" button and do not download or use the Application.
1. License
The Application is licensed, not sold. eyeDnow grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the Application solely for personal, non-commercial purposes ("Permitted Purposes") strictly in accordance with the terms of this Agreement.
2. Restrictions:
You agree not to:
license, sub-license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application in whole or in part or make the Application available to any third party;
translate, merge, adapt, vary, alter or modify, the whole or any part of the Application nor permit the Application or any part of it to be combined with, become incorporated in, any other programs or be subject to any charge;
attempt to disassemble, decompile, reverse engineer or create derivative works based on the whole or any part of the Application;
deal in any other manner with any or all of its rights and obligations under this Agreement, without the prior written consent of eyeDnow
3. Use of the Software:
You will only use the Application for the Permitted Purposes under this Licence. eyeDnow provides the Application “as is” and does not: (1) provide any warranties in relation to the performance of the Application and will not be liable in the case of a fault caused in relation to the Application that arises from any actions of you or a third party; (2) warrant that the use of the Application will be uninterrupted or error-free.
4. Modification to Application
eyeDnow has the complete right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
5. Term and Termination:
This Agreement shall remain in effect until terminated by you or eyeDnow. eyeDnow may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice. This Agreement will terminate immediately, without prior notice from eyeDnow, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application from your mobile device.
7. Device Data:
By using the Application, you agree to us collecting and using technical information about the devices you use the Application on and related software, hardware and peripherals to improve our products and to provide any services to you.
8. Limitation of Liability:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU UNDERSTAND AND EXPRESSLY AGREE THAT ONFIDO, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS WILL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU, INCLUDING ANY LOSS OF DATA, WHETHER OR NOT ONFIDO OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.
9. Severability:
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
